The membership of the Civil Service Commission (CSC) to the PhilHealth Board was by virtue of Section 12 of R.A. 10606 or the “National Health Insurance Act of 2013” which amended Section 18 of RA 7876 to include among others the Chairperson of the CSC or a permanent representative thereof as one of the seventeen (17) Directors of the PhilHealth Board. Several former Commissioners and other CSC Officials have represented CSC in various meetings and not only the incumbent Chairperson. With the passage of R.A. 11223 or the “Universal Healthcare Act” in 2019, the PhilHealth Board of Directors was reconstituted to have a maximum of thirteen (13) members, without CSC representation.

As to the jurisdiction over administrative cases involving government employees, CSC exercises either Original or Appellate. Original jurisdiction is exercised when it prosecutes and decides administrative disciplinary cases filed directly or instituted by CSC. On the other hand, Appellate jurisdiction is exercised when (1) administrative disciplinary cases are brought on appeal to the Commission; (2) cases involve decisions of agency heads on personnel actions; and (3) when cases brought on appeal involve disapproved appointments or any action/decision made by Civil Service Commission Regional or Field Offices.

Administrative cases filed within the jurisdiction of the Commission en banc are randomly assigned to the action officers of the Office for Legal Affairs (OLA). The action officers study the cases assigned to them and prepare the draft decisions or resolutions, which are reviewed by their division chief, and later, by their cluster director. OLA then forwards the draft decisions to the Commission Secretariat and Liaison Office (CSLO) for endorsement to the Commission en banc (1 Chairperson, 2 Commissioners) before the Commission Meeting (CM). During the CM, the Commission as a collegial body deliberates on the cases and decides them. As a collegial body, no member of the Commission can solely decide as to the disposition of any case.
